Any access to or use of the site implies compliance with and unreserved acceptance of all the General Terms and Conditions of Sale and Use. If you do not wish to accept all or part of these conditions, you are requested to refrain from using this site.

ARGANIA reserves the right to modify the terms, conditions and notices of these General Terms and Conditions of Sale and Use and legal notices. These modifications are deemed to have been accepted without reservation when you access the site after they have been put online.

You acknowledge that these Terms and Conditions constitute the complete and exclusive agreement between you and ARGANIA with respect to your use of the Site.

ARTICLE 1. ORDERS AND VALIDITY OF OFFERS 

1.1 ORDERING PROCEDURE

A detailed description of each product is available when you view it individually on the site.

This system requires an active approach on your part. It complies with the legal requirements for online sales and consumer protection.

To order the products you want, enter the product sheet of the items you wish to buy by clicking on their photo, choose the quantity you require, then click on "Add to basket". Your choices will be automatically added to your shopping basket, which you can consult at any time in the top right-hand corner of each page.

Once your basket is validated, choose your delivery method.

Then enter your delivery information. You can have a billing address different from the delivery address. To do this, click on "Ship to a different address".

Finally, choose your payment method (credit card, Twint or Paypal). If you forget any of the above, your order will not be valid.

1.2 ORDER ACCEPTANCE

ARGANIA undertakes to accept orders placed via the Internet, within the limits of available stocks, under the terms of the present document, which you must declare that you are aware of when you validate the order.

You must be in a position, before the conclusion of the contract, to know the essential characteristics of the products (nature, quantity, composition of the product, substantial qualities...), their price, the methods of payment accepted, the delivery period and restrictions as well as the period, conditions and procedures for exercising the right of withdrawal as well as the cases of exclusions for exercising this right.

For all purchases on our site, a confirmation e-mail will be sent to you mentioning your order number and details of the products ordered. Once your order has been processed, you will receive a shipping confirmation e-mail with delivery details.

1.3 LIMITATIONS

If a product is out of stock, ARGANIA will inform you by mail at the e-mail address you have provided, as soon as possible. ARGANIA will inform you of the lead times required to obtain the desired product or will offer you a replacement product of equivalent value.

ARGANIA is not able to manage backorders: if a product is out of stock without a specific restocking period, ARGANIA will offer you a refund of the product ordered, via the payment method used at the time of your order.

All orders will only be taken into consideration after full payment has been received and will be confirmed by ARGANIA by e-mail.

ARGANIA reserves the right to cancel any orders that are non-compliant, suspect or placed in bad faith. Furthermore, we reserve the right to refuse any order from a customer with whom there is any previous or current dispute.

ARTICLE 2. PRICES

Prices are quoted in Swiss francs and include all taxes (VAT and any other taxes applicable in Switzerland).

Prices are net prices and include the price of products, handling, packaging and storage costs. Prices are valid on the date the order is validated. Prices are subject to change without notice. They do not include postage and delivery charges, which may vary according to the amount and weight of the order and/or the country of dispatch.

Any order delivered outside Switzerland may be subject to local taxes and customs duties at the buyer's expense.

You may be asked to pay customs duties (except for deliveries within Switzerland) by the carrier at the time of delivery. These customs duties and taxes are your responsibility.

Under no circumstances will ARGANIA be held responsible for any additional costs related to the delivery of the order, excluding shipping charges, which are described and invoiced when you place your order on the site.

The price indicated in the order confirmation is the final price including VAT.

ARTICLE 3. PAYMENT

3.1 TERMS OF PAYMENT

Payment for products purchased on the site is made in full when the order is placed. The products remain the property of ARGANIA until the order has been paid in full.

Payments can be made by credit card (MasterCard, Visa, American Express, PayPal) or by Twint.

Your credit card or Twint account will be debited when your order is confirmed.

To this end, you guarantee that you are the holder of the bank card to be debited and that the name on the card is your own.

3.2 PAYMENT SECURITY 

The payment security protocol used is STRIPE. It guarantees total confidentiality of personal information transmitted over the Internet. Your credit card details are not stored on the site, and your payment can only be viewed in encrypted form using the SSL protocol (confirmed by the appearance of "https" in the URL displayed by your browser).

However, in order to facilitate the purchasing process for future orders, a system for saving your bank details is available. To do so, you must check the "Optional - Save this credit card" box on the payment information page of the site. Your bank details are stored on STRIPE's server in encrypted form only, and are only kept for as long as is strictly necessary to manage customer relations, and under no circumstances longer than 2 years from the date of your last order.

Saving your banking information is not mandatory to order on the site.

In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to all your personal data at any time. To do so, please write to info@argania.ch, providing proof of your identity.

ARTICLE 4. DELIVERY

ARGANIA delivers to several countries. All orders leave Switzerland via a logistics company, and no deliveries will be made to countries not on the list, or to P.O. boxes.

In the event of exceptional operations (e.g.: private sale, BlackFriday, Christmas...) organized by ARGANIA or a third party, products may be delivered within a longer period than usual.

4.1 DELIVERY METHODS

Packages are delivered by La Poste to the Customer's home address or to any other address of the Customer's choice (to be specified on the delivery form), provided that the Customer is located in Switzerland only.

Please note that during certain periods (sales, private sales...) processing times may be longer due to the large number of parcels to be processed.

  • Home delivery by Post Switzerland

If the Post Office has lost or damaged your parcel (a photo of the damaged box and contents must be sent as proof), ARGANIA will refund you for the damaged items or return the product to you.

If La Poste confirms that it has delivered the parcel to the address indicated, but you are the victim of theft, neither La Poste nor ARGANIA can grant a refund. In this case, the customer must take out insurance or contact the police to report the theft.

4.2 DELIVERY DEADLINES

ARGANIA undertakes to do its utmost to deliver the products ordered within the time indicated when choosing the delivery method, plus 24 hours for the management and preparation of your order. Orders placed on the site on Friday afternoon, Saturday or Sunday will not be processed until the following Monday. In addition, orders placed on the site on a public holiday (Swiss) will not be processed until the following working day.

In the event of a delay of more than 14 days from the date of the order (except in the cases mentioned above or in cases of force majeure), the customer may :

  • Or notify the delay by e-mail to info@argania.ch. In this case, ARGANIA will contact the postal services in order to carry out an investigation which will not exceed 30 days. At the end of the investigation, if the parcel has not been located, the customer will be able to choose between returning the said order or a refund of the amount of the order.
  • Or cancel the order and request a refund by sending an e-mail to ARGANIA at info@argania.ch.

4.3 DELIVERY COSTS

The flat-rate preparation and delivery costs depend on the customer's country of delivery and the weight of the package.

4.4 TERMS OF DELIVERY

The order is delivered to the delivery address you have chosen. The information given and recorded at the time of the order is binding. In the event of an error in the recipient's contact information, ARGANIA cannot be held responsible for the impossibility of delivering the product(s) as a result of this error. Furthermore, in this case, ARGANIA will not be able to make a second delivery without an exchange with the buyer and additional delivery charges may be invoiced for the second delivery.

Products are shipped at ARGANIA's risk. Risks are only transferred to the customer upon delivery of the products to the address indicated by the latter.

ARGANIA guarantees that the products are in perfect condition when delivered to the carrier. If the products are damaged, your reservations must be made in writing to the carrier at the time of delivery, or no later than 4 hours after delivery. A copy of these reservations must be sent to ARGANIA by e-mail to info@argania.ch.

If the above procedure has been followed, and if it is thus proven that the reservations are due to the fact that the package and the products are damaged, ARGANIA will, at its discretion, issue a credit note, reimburse the customer for the price paid or make a new delivery of similar products.

ARTICLE 5. RIGHT OF WITHDRAWAL

Pursuant to the provisions of the Swiss Consumer Code, ARGANIA is prohibited from reselling a consumable product received in return, which is why no right of withdrawal will be accepted. Except, of course, in the event of an order error on the part of ARGANIA, the correct order will be returned to the customer free of charge.

In the event of cancellation of an order for a package that has not yet been dispatched, a cancellation fee of CHF 9.00 may be charged.

In the event that ARGANIA has physical boutiques or these products are sold in multi-brand boutiques, the products cannot be returned in these boutiques.

ARTICLE 6. COMPLAINTS

If you have any questions about an order, ARGANIA's customer service department customer service is available to assist customers via the "Contact us" section. In the event of a dispute, customers must provide their order number and the exact reason for their request. Once a dispute has been resolved, if a refund is necessary, it will be made directly to the customer's bank account. Inquiries with La Poste regarding the delivery of any parcel must not exceed 30 days. After 2 months, once a "complaint" file has been opened, requests for reimbursement can no longer be considered.

ARTICLE 7. RETENTION OF TITLE

The products delivered to you are sold under reservation of title. The transfer of ownership is subject to full payment of the price of the products, on the due date agreed between the parties.

The products therefore remain the property of ARGANIA until full payment has been received.

ARTICLE 8. LIABILITY

ARGANIA undertakes to take all necessary care in the implementation of the service offered to you.

The site provides you with information (photos, texts) for information purposes, as is, with all their imperfections, errors, omissions, inaccuracies and other ambivalences that may exist, and are in no way contractual. Furthermore, this information must be taken into consideration at the time it is put online and not at the time the site is consulted.

ARGANIA cannot be held responsible for the non-performance of the contract in the event of :

- Out of stock or product unavailability

- Disruption, total or partial strike, in particular of postal services or means of transport and/or communications.

- For any interruption, malfunction or unavailability of access to the site

- For any misuse or incorrect configuration of your computer

- For any damage of any nature whatsoever resulting from fraudulent intrusion by a third party leading to modification of the information made available on the site.

- For any failure due to a fortuitous event or force majeure such as, and without limitation, disasters, strikes, fires, floods, failure or breakdown of equipment, means of transport, communications or due to your actions.

- For any indirect damage such as loss of profits, loss of earnings, loss of data, loss of clientele, etc., which may result from the use of the site, or the impossibility of using it.

In any case, whatever the reason for ARGANIA's liability, its responsibility is limited to the lower of the two sums: (i) the amount of the direct loss suffered by the customer or (ii) the price of the order.

ARTICLE 9. INTELLECTUAL PROPERTY

Use of the site is strictly personal. In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this site and all elements, trademarks, designs, models, logos, graphics, etc. found on this site as well as their compilation are the exclusive property of ARGANIA or its suppliers, the latter not granting any license or any right other than that of consulting the site. ARGANIA reminds you that any reproduction, use or modification, in whole or in part, of any element of the site is strictly forbidden without the prior, special and express authorization of ARGANIA. Consequently, ARGANIA may take legal action, in particular for counterfeiting, against all those who, directly or indirectly, infringe its rights.

ARTICLE 10. DURATION  

The present terms and conditions apply for the duration of the online availability of the products and services offered for sale by ARGANIA.

ARTICLE 11. PROOF

The computerized records kept in the information systems of ARGANIA and its partners under reasonable conditions of security will be considered as proof of communication, orders and payments between ARGANIA and the Customer.

ARTICLE 12. APPLICABLE LAW - DISPUTES

This contract is subject to Swiss law. The language of this contract is French. In the event of a dispute, the Swiss courts shall have exclusive jurisdiction.

ARTICLE 14. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

In view of possible changes to the Site, ARGANIA reserves the right to adapt or modify these terms and conditions of sale at any time. The new general terms and conditions of sale will, where applicable, be brought to the attention of the customer by online modification and will only apply to sales made after the modification.
